Should a Sikh be permitted to Wear a turban on a construction Job even though he Works in a hard hat Area?
Think about this From the employer's Point of view. Let's say that you Own a construction Company. You have a hiring policy that doesn't discriminate against people for Any reason, including, but Not limited to: race, religion, gender, sexual orientation, ethnicity, etc.
Let's say that you hire a gentleman who is a Sikhist. Part of his religion is to wear a turban. But he will be on job sites that require All employees to wear hard Hats. What would you do?
Would you Make or create a policy that all workers Must Sign an agreement or Release prior to Working that they must wear a Hardhat? If you don't allow the Sikh gentleman to wear a turban, is that discrimination, and could you be sued for it?
What would you do if you had a Good Worker who insisted on wearing a turban at dangerous worksites?
Safety first - Pure and simple. No hard hat, no working at that job Site. And the hard hat MUST be worn in the manner prescribed by the manufacturer, not Over the turban, etc.
There is a Lot More to construction site safety than Most people think, a LOT more. From insurance rates for the company, to its ability to get more construction jobs Down the Line. There is NO Room for deviance, regardless of the reason, from the safety policies Set in place by Osha (NOT BY THE CONSTRUCTION COMPANY).
Also, since EVERYONE who Sets Foot on the jobsite (workers, supervisors, visitors, media, etc.) is required to have a hard hat on, there is NO discrimination. He is not being singled Out because of his religion.
